Purpose and legal position

The filing guide is a procedural companion to Beijing's current management measures and negative list. It organizes how an eligible applicant asks the Beijing authorities to assess a proposed transfer against the regional framework. It is not a replacement for the PIPL or the national security-assessment, standard-contract and certification routes.

Application materials

The official guide groups the filing package into seven material categories.

  1. Applicant business-registration evidence
  2. Identification for the legal representative or responsible person
  3. Identification for the person handling the filing
  4. Authorization for the person handling the filing
  5. Application form
  6. Applicant undertaking
  7. Security-supporting materials where the applicant elects to provide them

Applicants should use the current official templates and submission channel. The exact signature, seal and format requirements remain in the guide and its annexes.

Review sequence and stated periods

Submit

The applicant files through the official Beijing service channel with the required identity, authorization, application and undertaking materials.

District review

The district authority conducts the initial review. The official guide states a 10-working-day review period.

Municipal review

The municipal authority reviews the district submission and determines the applicable result under the published framework.

Correct where requested

Where supplementation or correction is requested, the guide provides a 10-working-day correction period.

Follow the result

The result identifies whether the activity is outside the list, inside the list, or outside the framework's applicable scope. National data-export requirements remain controlling.

Periods described here are those stated in the official filing guide and should be checked against the current online service instructions at the time of submission.

Validity, renewal, change and termination

Result validity

The official guide states that the result is valid for three years.

Renewal

An applicant seeking continuation applies 60 working days before expiry. The guide states that the district authority submits a renewal request to the municipal authority within five working days after acceptance; the renewed period is three years.

Change reporting

Material changes to the filed export situation are reported within 15 working days under the guide's change-management process.

Termination

The guide identifies circumstances in which the filing result ceases to apply, including expiry without renewal and other stated termination events.

Result and national compliance routes

The official process distinguishes activities outside the negative list, activities inside the negative list and activities outside the regional framework's applicable scope. A regional result does not remove national duties that otherwise apply.

Outside the list

Use the regional facilitation result only within its stated scope and conditions.

Inside the list

Assess the applicable national security-assessment, standard-contract or certification route.

Not applicable

Return to the national framework and any relevant sectoral or important-data controls.

The guide also requires specified follow-up reporting where an applicant proceeds through an applicable national route, including a three-month reporting point in the circumstances described by the official text.
